These Terms of Service ("Terms") apply to your use of mimiafi.com (the "Store") and any purchase you make from MIMI ("we", "us", "our"). By using the Store or placing an order, you agree to these Terms. Please read them together with our Shipping Policy, Refund & Returns Policy and Privacy Policy.
1. Your consumer rights
Nothing in these Terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993 or any other law that cannot be excluded. Where these Terms conflict with those laws, the law applies.
2. Using the Store
You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. You agree to provide accurate information and not to use the Store for any unlawful or fraudulent purpose.
3. Products and pricing
- We try to describe and photograph our products as accurately as possible. Colours may appear slightly different depending on your screen, and measurements may vary slightly.
- All prices are in Australian dollars (AUD). Shipping costs are shown at checkout.
- We may change prices, products and availability at any time. Changes won't affect orders we have already accepted.
- If a product is listed at an obviously incorrect price because of an error, we may cancel the order and give you a full refund.
4. Orders
Your order is an offer to buy. We accept it when we dispatch your items. We may decline or cancel an order, for example if an item is out of stock or we suspect fraud. If we cancel an order after you've paid, we'll refund you in full.
5. Payment
Payment is taken at checkout through our secure payment providers. By paying, you confirm that you are authorised to use the payment method.
6. Shipping and delivery
Delivery times are estimates and are set out in our Shipping Policy. Responsibility for the goods passes to you when they are delivered to the address you gave us.
7. Returns and refunds
Returns and refunds are handled under our Refund & Returns Policy, which does not limit your rights under consumer law.
8. Intellectual property
The content on the Store, including text, graphics, logos and our own photos, belongs to MIMI or our licensors. You may not copy or use it for commercial purposes without our permission.
9. Limitation of liability
To the extent permitted by law, and subject to section 1, we are not liable for any indirect or consequential loss arising from your use of the Store. Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, it is limited to replacing the goods, supplying equivalent goods, or refunding the price paid.
10. Changes to these Terms
We may update these Terms from time to time. The version on this page when you place your order applies to that order.
